Terms & Conditions

 

OBJECT

  1. GSX Portugal Unip. Lda. ("GLOBALSPORT"), with registered office at Rua D. Manuel Vieira de Matos, nº 70, 5050-345 Poiares, with share capital of €5,000, registered at the Commercial Registry Office of Sintra under registration and corporate tax number 514 779 012, operates in the fields of tourist activities, other sporting events not otherwise classified, trade fairs and similar events. GLOBALSPORT offers its clients ("Clients") the possibility of acquiring products and services related to these activities.

  2. These Terms and Conditions govern access to and use of all websites owned by GLOBALSPORT, through which Clients can view information about the services and products offered by GLOBALSPORT ("Products and Services") and place orders electronically ("Order").

  3. Products and Services purchased will be delivered in Portugal or in other countries as indicated in the purchase form.
    3.1. Digital Products and Services will be delivered to the email address provided by the Client.

  4. All Products and Services available through the Online Store comply with the requirements of Portuguese law.

  5. The information and data provided by the Client when placing an Order will have full legal effect. The Client may not claim lack of signature as justification for failing to meet their obligations.

  6. Placing an Order implies that the Client has read, understood, and accepted these Terms and Conditions.

  7. GLOBALSPORT reserves the right to amend or review these Terms and Conditions at any time. Any such changes will be published at www.globalsport.pt

INFORMATION ON PRODUCTS AND SERVICES

  1. Products and Services have the characteristics described in the Online Store. Their use after purchase is the sole responsibility of the Client.

  2. GLOBALSPORT cannot guarantee the constant accuracy of the information provided online. However, any errors will be corrected as soon as detected.

  3. In the event of errors beyond GLOBALSPORT's control (e.g. human or IT errors), and if a Product or Service cannot be delivered, GLOBALSPORT will inform the Client and offer a full refund.

  4. GLOBALSPORT reserves the right not to complete an Order if technical issues result in incorrect prices or characteristics being displayed, and will inform the Client accordingly.

  5. GLOBALSPORT may alter the sales conditions of Products and Services at any time, including prices and features.

  6. All prices include VAT at the legal rate in force.

  7. Online payment service providers may charge transaction fees. For Multibanco payments, the system will automatically select the provider with the lowest fee.

  8. The offer of Products and Services is subject to stock availability.

ORDER PLACEMENT

  1. The fields marked as mandatory must be completed to proceed with the Order. Omission or inaccuracies are the Client's sole responsibility and may lead to the Order not being fulfilled.

  2. The Client is fully responsible for the authenticity and accuracy of the data provided. Incorrect or incomplete information may lead to restriction of future access to the Online Store.

  3. To place an Order, the Client must select "Add to Cart" next to the desired Product or Service.

  4. The Client may review or modify the Order before dispatch, including changing quantities or removing items.

  5. After selecting Products and Services, the Client must confirm the Order, enter the requested data, and select a payment method. Once validated, the Order is confirmed and the Client will receive an email confirmation.

ORDER DELIVERY

Delivery to the Client's Address:
The delivery address must be specified during the Order process. Deliveries cannot be made to PO boxes in Portugal or other countries. Orders are shipped according to GLOBALSPORT's logistical availability, except in cases of stock outage. Deliveries in Portugal are made on business days between 09:00 and 18:00. Delivery times in other countries are defined by the respective courier service. If the Client is not available to receive the delivery, a notice will be left. Undelivered items will be returned to GLOBALSPORT and the Order cancelled. All related costs will be charged to the Client.

Delivery via Email:
Digital Products and Services will be sent to the email address provided by the Client. The accuracy and operability of the email address are the sole responsibility of the Client. Please note that emails may be redirected to the spam folder.

PAYMENT

The following payment methods are available:

a) Multibanco:
Payment may be made at an ATM or via online banking. The Client will receive the payment entity, reference, and amount, and has three (3) consecutive days to complete the payment. If payment is not received within this period, the Order will be cancelled. This method is valid only in Portugal.

b) PayPal:
PayPal is a secure method that uses the Client's credit card data. For more information, visit www.paypal.com.

ORDER CANCELLATION

  1. Orders cannot be cancelled by the Client once payment has been made.

  2. GLOBALSPORT may cancel an Order if discrepancies are found in the Client's personal data or if these Terms and Conditions are violated.

RETURNS

Returns are not accepted.

WARRANTY

  1. Warranty is provided as per the manufacturer's conditions. Digital Products and Services do not carry a warranty.

  2. Once the warranty period has expired, or in the case of exclusions, any repair costs will be borne by the Client.

  3. The Client must retain the invoice received at delivery as proof of purchase.

CLIENT OBLIGATIONS

  1. The Client declares to have the legal capacity to accept these Terms and Conditions.

  2. The Client agrees to:
    a) Respect these Terms and Conditions and applicable laws
    b) Provide accurate and up-to-date information
    c) Not use false identities or misrepresent their identity
    d) Refrain from unlawful activities or those that infringe on GLOBALSPORT's or others' rights
    e) Not interfere with the operation of the Online Store
    f) Not upload or transmit malicious software or content

SUSPENSION OF ONLINE STORE

  1. GLOBALSPORT reserves the right to suspend or terminate access to the Online Store and to request verification of client-provided information.

  2. GLOBALSPORT may block access in cases of breach or attempted breach of these Terms and Conditions, without the Client having any right to compensation.

MAINTENANCE

  1. GLOBALSPORT aims to provide regular and uninterrupted access to the Online Store. However, access may be affected by unexpected system overloads or force majeure.

  2. GLOBALSPORT does not guarantee the Online Store will be error-free or continuously available.

  3. GLOBALSPORT will restore access as soon as technically possible after interruptions caused by its own systems.

PRIVACY & DATA PROTECTION

  1. GLOBALSPORT guarantees the confidentiality and protection of all data provided by Clients.

  2. Personal data collected during Orders is processed in accordance with applicable laws and used exclusively for the intended purpose.

  3. Clients have the right to access, rectify, and update their personal data at no cost.

  4. Clients must comply with data protection laws, particularly in electronic communications.

LIABILITY

  1. GLOBALSPORT is not liable for delays, interruptions, or anomalies caused by factors beyond its control, including third-party communication failures or internet issues.

  2. Except in cases of wilful misconduct or gross negligence, GLOBALSPORT is not responsible for:
    a) Service disruptions caused by network failures
    b) Data loss or Online Store malfunctions
    c) Damages caused by third parties

  3. GLOBALSPORT has implemented adequate security measures but cannot guarantee full protection of data transmitted over the internet. Clients are responsible for keeping login credentials secure.

  4. GLOBALSPORT is not liable for defects or incompatibilities with Clients' devices.

  5. All operations are presumed to be carried out by the registered Client.

  6. Clients are responsible for:
    – Using appropriate hardware and software
    – Covering access costs
    – The information they publish online

  7. Clients acknowledge that online data may be protected by copyright or intellectual property rights.

  8. GLOBALSPORT does not guarantee that Product or Service characteristics will meet the Client's expectations.

INTELLECTUAL PROPERTY

The Online Store is a registered site of GLOBALSPORT. All logos, trademarks, and symbols used are owned by GLOBALSPORT or used with proper authorisation.

GOVERNING LAW AND JURISDICTION

  1. These Terms and Conditions are governed by Portuguese law.

  2. Any disputes regarding interpretation or execution shall be submitted to the exclusive jurisdiction of the Court of Porto, with express waiver of any other jurisdiction.
